I couldn&#8217;t resist.<\/p>\n<p>The podcast is now available, <a href=\"http:\/\/www.businessweek.com\/mediacenter\/podcasts\/podcasting\/current.html\">both on iTunes (though I couldn&#8217;t find it a few days ago) and via an mp3 download<\/a>. Maybe he missed this item previously for sale on Etsy: Gameboy cufflinks (<a href=\"http:\/\/blog.rebang.com\/?p=888\">reLink<\/a>). Considering the kinds of legitimately-licensed stuff that has carried the Nintendo logo &#8211; like <a href=\"http:\/\/www.thinkgeek.com\/geektoys\/japanfan\/84fe\/\">these keychains<\/a> which aren&#8217;t too different from <a href=\"http:\/\/www.amazon.com\/Nintendo-Super-Mario-Maskot-Keychain\/dp\/B000JIJKHC\/sr=8-5\/qid=1166376049\/ref=sr_1_5\/105-2152993-0310046?ie=UTF8&#038;s=apparel\">these keychains on Amazon<\/a>, which themselves aren&#8217;t too different from <a href=\"http:\/\/www.etsy.com\/view_listing.php?listing_id=341556\">this supposedly &#8220;craft&#8221; pendant on Etsy made by someone in &#8230; Oregon<\/a>? or <a href=\"http:\/\/www.etsy.com\/view_listing.php?listing_id=621117\">this pendant on Etsy made by someone in Long Beach<\/a>? &#8211; I have my doubts Nintendo or any judge would call those very likely unlicensed items Fair Use. I mean, Nintendo licenses their character images to be used on <a href=\"http:\/\/query.nytimes.com\/gst\/fullpage.html?res=950DEFDF1130F93BA25756C0A96F948260\">boxer shorts (Link)<\/a>, so does anyone think they&#8217;d ignore keychains and pendants? Well, you don&#8217;t have to guess, <a href=\"http:\/\/www.nintendo.com\/consumer\/retail\/licensee_merchandisers.jsp\">they have a list (Link)<\/a> of some things already licensed&#8230; and keychains is on it.<\/p>\n<p>I have a feeling Etsy is going to have to figure out how to deal with illegal consumer content sooner rather than later, because unlike YouTube and Second Life and all the non-tangible stuff out there which doesn&#8217;t really cost anything to replicate, companies that pay a licensing fee and invest money into the manufacturing of physical goods are going to have a problem with the growth of easy-to-market-and-sell sites like Etsy.
